These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and CallBreezy LLC ("CallBreezy," "we," "us," or "our"), governing your access to and use of the CallBreezy VoIP communication platform and related services (collectively, the "Services").
By registering for an account, clicking "I Agree," initiating a subscription, or otherwise accessing the Services, you confirm that:
CallBreezy provides cloud-hosted Voice over IP ("VoIP") communication services, including but not limited to:
The Services are provided on a subscription basis and are subject to these Terms, our Acceptable Use Policy (Section 8), and any plan-specific documentation provided at the time of purchase.
You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for all activity that occurs under your account, including the actions of any users you grant access to.
You are solely responsible for maintaining the confidentiality of your credentials. You agree to notify CallBreezy immediately at [email protected] of any unauthorized use of your account or any other security breach. CallBreezy will not be liable for any loss resulting from unauthorized use of your account.
The Services are intended for legitimate business communication purposes. Residential-only use is not prohibited but the Services are designed and priced for business environments.
CallBreezy offers the following monthly subscription tiers:

All subscriptions are billed on a monthly recurring basis. Recurring charges are processed on the 1st of each calendar month. By subscribing, you authorize CallBreezy to charge your payment method on file each month until you cancel.
We accept all major credit and debit cards processed through Zoho Payments. You represent that you are authorized to use the payment method you provide. CallBreezy reserves the right to suspend or terminate your account if a payment is declined or reversed.
If a payment fails, CallBreezy will attempt to re-process it. If payment remains outstanding for more than 7 days, your account may be suspended. Suspended accounts retain their configuration data for up to 30 days before permanent deletion.
Stated prices do not include applicable federal, state, or local taxes, regulatory fees, or surcharges. These will be added to your invoice as required by law. Telecom-specific surcharges (e.g., USF, E911) may apply.
When you subscribe to CallBreezy on any day other than the 1st of the month, your first charge is prorated to align all future billing to the 1st of each month.
After the initial prorated period, your subscription renews at the full plan price on the 1st of each subsequent month. You will always see a breakdown of any prorated charges in your checkout summary before completing payment.
You may cancel your subscription at any time by contacting CallBreezy support at [email protected] or through your account dashboard. Cancellations must be submitted at least 3 business days before your next billing date to avoid being charged for the next month.
Upon cancellation:
All subscription fees are non-refundable. CallBreezy does not provide partial-month refunds upon cancellation. The prorated first-month charge described in Section 5 is also non-refundable once the billing period has begun.
You may request to port an existing telephone number from your current carrier to CallBreezy. Porting is subject to carrier availability and regulatory requirements. We do not charge a fee to port numbers in, though your losing carrier may impose its own charges.
If you wish to transfer a CallBreezy-assigned telephone number to another carrier upon cancellation or otherwise, a port-out fee applies per number.

To initiate a port-out, email [email protected] with the subject line "Port-Out Request" and include: the telephone number(s) to be ported, your receiving carrier's name, and the account holder name. We will provide a Letter of Authorization ("LOA") and account information after the port-out fee is collected.
CallBreezy cannot guarantee number availability or porting timelines, as these are subject to third-party carrier processes. Port-out requests are typically processed within 5–7 business days.
You agree not to use the Services for any purpose that is unlawful, harmful, or prohibited by these Terms. Without limitation, you may not:
CallBreezy reserves the right to immediately suspend or terminate your account for any violation of this Acceptable Use Policy without notice or refund.
CallBreezy targets 99.9% monthly uptime for its core VoIP platform, excluding scheduled maintenance windows (communicated at least 48 hours in advance) and events outside our reasonable control.
CallBreezy does not guarantee uninterrupted service and is not a substitute for traditional E911 services. You acknowledge that VoIP calls, including emergency 911 calls, may not function during power outages, internet disruptions, or platform maintenance.
We strongly recommend maintaining an alternative method for reaching emergency services. By using CallBreezy, you accept these E911 limitations.
All content, software, trademarks, logos, and materials comprising the CallBreezy platform are the exclusive property of CallBreezy LLC or its licensors. Nothing in these Terms grants you any right, title, or interest in CallBreezy's intellectual property other than the limited license to use the Services as described herein.
You retain ownership of all data, voicemail messages, and call recordings associated with your account. You grant CallBreezy a limited license to process and store such data solely for the purpose of providing the Services.
Your use of the Services is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CALLBREEZY DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CALLBREEZY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL CALLBREEZY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO CALLBREEZY IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to defend, indemnify, and hold harmless CallBreezy and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) any content transmitted through your account.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
Before initiating any formal dispute, you agree to contact CallBreezy at [email protected] and attempt to resolve the dispute informally. Most concerns can be resolved quickly through our support team.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English, and judgment on the award rendered may be entered in any court of competent jurisdiction. You waive any right to a jury trial for such disputes.
You agree to resolve disputes with CallBreezy on an individual basis only and waive any right to participate in a class action, collective action, or representative proceeding.
CallBreezy reserves the right to update these Terms at any time. When we make material changes, we will notify you via email at the address associated with your account and/or post a notice on our website at least 14 days before the changes take effect.
Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must cancel your subscription before the effective date.
